Comparative Law of Contracts Seminar

This seminar will engage first in an analysis of some theoretical issues relating to the comparison of law (such as the attempts to classify the various legal systems, the methods used in comparative law, the role of comparative law in courts and law reform), in order to then discuss some selected substantive topics relating to contract law. In particular, the seminar will examine the notion of “contract” in light of both domestic legislation and international instruments, the various categories of contract, the scope of contract law (as compared to that of tort law and the law of restitution), the formation and validity of contracts as well as the remedies for non-performance.
